This blog post will help to provide basic law on the statute of limitations in California on some of the more common legal claims in civil cases (not criminal cases).
If somebody assaults or batters you, or causes you injury or death by some wrongful act or negligence, you have TWO YEARS to file your civil case. You can review the full text of the applicable code HERE - CCP 335.1.
Here's an example: As you drive in your car, a negligent driver runs a red light injuring you and causing property damages to your car. You must file suit within two years of the accident or lose your right to sue.
If you have an obligation, contract or liability in writing, you have FOUR YEARS to sue.
Here's an example: You enter into a written agreement to loan your best friend $25,000. On January 1, 2012, your friend signed the written contract. On January 1, 2013, your friend stopped making payments, i.e., breached the agreement. If have 4 years to file suit or lose the right to sue altogether.
Remember! There are also exceptions and nuances in the law so do not hesitate to contact Christman, Kelley & Clarke by email HERE.
